Additional Property Attributes

The 7.8-acre ADW Site consists of three parcels identified by the Town as Map 31, Lot 477; Map 32, Lot 6; and Map 32, Lot 9. The Site also includes a portion of the Ten Mile River Pond ("Pond"). The Site is improved with three buildings, two of which are partially collapsed and fire damaged. A former two-story, 101,000 square foot (SF) structure, constructed circa 1920 and referred to as the "industrial facility building,", constructed of concrete block, was formerly utilized for industrial purposes and more recently, prior to the 2012 fire, was occupied by multiple commercial tenants. The building is located at the northern portion of the Site and abuts the Ten Mile River ("River") to the south. Portions of the building appear to have been constructed on a basement. Over 70% of the structure was destroyed in a May 2012 fire. The southwestern portion of the building remains intact and the eastern portion of the structure was destroyed. Fire damaged construction debris remains along the building footprint and extends west of the building footprint. A two-story 3,500 SF building was formerly used for office space. This building is located to the south of the industrial building and was not damaged in the 2012 fire. The building was constructed circa 1960. A two-story 400 SF building, constructed of concrete block, is located on the southeastern portion of the Site, and was formerly used as a pump house and constructed circa 1960. The majority of the structure was destroyed in the 2012 fire. The Town acquired the property as a tax taking on November 6, 2019.
The Site is located in an area of mixed commercial and residential usage, and is abutted to the north by the River; to the northeast by thePond, which was formed by a dam; to the southeast by an automotive repair facility and residences; to the southeast by a church and Mill Canal; to the south by Maple Avenue; to the southwest by residences; and to the west by undeveloped land. The Pond is intermittently dry, which is attributed to a breach in the dam.
The Massachusetts Contingency Plan (MCP) Disposal Site includes 36 Maple Avenue (with the exception of Lot 9 and Ten Mile River Pond) and Mill Canal, located to the southeast of 36 Maple Avenue, which measures approximately 800 feet in length, and is situated between two vacant parcels (identified as Parcels 265-32-4 and 265-31-465) and are privately-owned.
Historically, water was diverted from the Pond and routed via an underground culvert ("Raceway") beneath the industrial facility building and "out to the northwest of the parking area", where the pipe discharged to a "man-made drainage channel", referred to as Mill Canal. Three former Lagoons/Impoundments ("Lagoons") and a suspect former 4th lagoon, are located at the western/northwestern portion of the Site. Two of the Lagoons (Lagoons #2 and #3) are surrounded by a fenced enclosure, to mitigate a Condition of Imminent Hazard (IH).
Site access is restricted along portions of the Site, which include a fenced enclosure along the southern portion of the Site, with a locked gate. Additional fencing at the Site restricts access to the western portion of the Site building and the burned building debris field. The Town installed the fencing in 2012, which restricts access to trespassers as a safety measure and also mitigates potential risk of exposure to Site contaminants.
