Additional Property Attributes

Former Use: The Clarus Lyons property reportedly operated as a gas station in the 1930s and 1940s and ceased operation prior to UST regulations. Later, the property served as a hot iron welding shop for repairing farming equipment, then as a shop to shred old tires, and finally a residential trailer court. Mr. Lyons purchased the property in 2006 from Donald and Eleanor Chevalier and operated the trailer court as an absentee landlord from his home in San Jose, California. Mr. Lyons was aware that there were USTs in the ground but was told by the previous owner that the tanks were filled with sand. The Mayor of Dutton, Susan Fleshman, contacted Mr. Lyons about purchasing the property, as it is located adjacent to a city park. The proposed purchase would include lots 4 through 9 in Block 26 of the first addition to the Town of Dutton which included 3 trailers. The City later purchased the lots but did not buy lots 10 through 12 due the perceived contamination caused by the USTs on those lots. The Town of Dutton did not want to be held liable for any contamination on the site.
