Chemetall Foote Corporation has owned the site since 2003. Chemetall Foote Corporation is currently working with Esmeralda County to convey the 1.93-acre portion of the parcel to county. The Town of Silver Peak does not have any public restrooms available to residents and travelers. Silver Peak Road, which is located adjacent to the parcel, connects Silver Peak to Goldfield and provides travelers access through the County to surrounding recreational areas such as the Silver Peak Range, Montezuma Peak Range, White Mountain Peak, Inyo National Forest, and the Boundary Peak Wilderness Area. Mining companies within Silver Peak also require daily deliveries that travel through the town. The transfer of this parcel would allow traffic in and through Silver Peak access to a public restroom. The construction of the public restroom would be partially funded by a US Department of Agriculture Rural Development Community Facility Program grant. Based on the Phase I ESA report, evidence of tailings was observed in historical aerial photographs and topographic maps and they appear to have been present on the Subject Property from as early as 1952. The tailings observed in these historical records appear to have originated from mining activities that had occurred upgradient to the west of the Subject Property. During site reconnaissance, evidence that these tailings were still present on the property was observed. According to anecdotal evidence, the tailings may have migrated onsite due to floods emanating from mining extraction tanks located upgradient. It is unknown if these tailings were affected by hazardous constituents.
