Additional Property Attributes

This assessment has revealed no evidence of recognized environmental conditions in connection with the Property except for the following: � The illegal dumping at the Property, the unknown source of fill materials at the Property and the known soil contamination at the Property (Section 4.1, 4.2.1 and 4.4.2). � The known soil contamination and open dumping on the north and west-adjoining site and the potential for groundwater migration onto the Property (Section 4.1 and 4.4.3). � The historical use of the north proximate site as well as the potential for migration of contaminants from unknown or unreported releases at the former junkyard (Section 4.4.3). � The presence and unknown origin of approximately 15 drums located throughout the southwest portion of the Property (Section 5.3.5). � The potential for migration of contaminants from unknown or unreported releases from the automotive sales and service facility (Fastlane Automotive Accessories and Sales) adjoining the Property to the east (Section 5.5). At the time of the reconnaissance, the Property consisted of an approximately 21 acre, irregular shaped parcel of land segregated by three areas of elevation. The northeast area of the Property was comprised of a gravel driveway with landscaped grass and a wooded area. Near the entrance to the Property, a retaining wall structure was constructed of large concrete blocks. The structure was formerly used to segregate gravel and sand and was painted with the name �CAB-X�. The gravel driveway extended from the entrance of the Property to the central and northwest portions of the Property (topographically higher). The central and northwest areas of the Property were elevated from the surrounding areas and appeared to be constructed with fill. The third, lower area of elevation was located at the southwest tip of the Property. The lower elevation, adjoining the Ohio River, was overgrown with dense vegetation and covered in driftwood and miscellaneous debris from past flooding.

Former Use: The Site is located in a mixed industrial, residential, and undeveloped area. It is bordered to the north by undeveloped land, to the south by residential properties and the Ohio River, to the east by Emery Crossing Road, and to the west by Raymond Senn and Benjamin Mars Company, a landfill that accepts construction debris including brick, concrete, asphalt, and soil fill materials. The Kentuckiana Disposal Company, located adjacent and southeast of the Site, is a solid waste disposal company. Debris and several dumpsters are located on the property. The Site is currently owned by Marshall�s Auto Sales, Inc., and is zoned as I-1 Industrial. It consists of a 26.65-acre lot with one building, three storage sheds, and several trailers, some of which are used for storage, located on the northwest corner of the Site. The center portion of the property is a former construction debris dump area that is approximately 30 feet ft higher in elevation than the remainder of the property and spans approximately 10 acres. According to the previous Site owner, Mr. Chet Richardson, the dump area is composed of construction debris/fill material including concrete, asphalt, soil, and brick materials similar to the materials being disposed of at the Raymond Senn and Benjamin Mars Company adjacent and west of the Site. Dumping/filling is believed to have taken place at the Site from approximately 1974 to 2007. In addition, Mr. Richardson indicated that the Site had been excavated approximately 20 ft below ground surface bgs prior to filling with construction debris, indicating that the debris could be as much as 50 ft deep. In addition, according to representatives of the Town, the dump area is under an enforcement order but is considered �closed� from IDEM�s perspective because the Site has been graded, covered, and capped with a vegetative cover in conformance with what was agreed upon in the enforcement order.
