The KDHE conducted a Phase I Brownfields Targeted Assessment (BTA) for the Fort Scott/Bourbon County Riverfront Authority (Riverfront Authority) to support the Riverfront Park redevelopment project. Based on the Phase I report, �Recognized Environmental Conditions� (RECs) were identified as potential releases of hazardous substances and/or petroleum products associated with possible historical dumping or placement of fill materials. Due to the potential for impacts to soil and/or groundwater, a Phase II assessment was conducted. The Phase II investigation was combined with Riverfront BTA properties #3 (C3-006-72368) and #7 (C3-006-73062) and consisted of collecting a total of 12 soil and four groundwater samples which were submitted to the laboratory for Resource Conservation and Recovery Act (RCRA) metals, volatile organic compounds (VOCs), total petroleum hydrocarbons (TPH) diesel range organics (DRO) and gasoline range organics (GRO), and polycyclic aromatic hydrocarbons (PAHs) analysis. Results of the Phase II identified lead in the soil above the KDHE Risk-Based Standards for Kansas (RSK) residential level of 400 milligrams per kilogram (mg/kg). In particular, results from soil sample Test Pit #4 (1-3 feet) reported a lead concentration of 500 mg/kg. Additional metal contaminants and several PAH constituents were also detected in this soil sample but at concentrations below KDHE RSK residential levels. No other contaminants of concern were detected above laboratory reporting limits in any other soil samples collected on the property. While groundwater samples were not collected on the property, several were collected on adjoining properties. Additionally, a Groundwater Potability Assessment was completed (report dated June 3, 2014) for properties located along the Riverfront as part of the Phase II assessment activities conducted under the KDHE Brownfields Coalition Grant (BF97741501). Based on the findings presented in the June 2014 report, the estimated yield for the shallow groundwater aquifer is 3.4 to 5.8 gallons per day (gpd). In accordance with KDHE BER Policy BER-RS-045 Considerations for Groundwater Use and Applying RSK Standards to Contaminated Groundwater the groundwater aquifer located in the vicinity of the riverfront is low yielding (i.e., less than 150 gpd), and therefore, not considered to be a potable aquifer. The lead impacted soil discussed above correlates to fill material encountered during the test pit excavation activities noted on the log for Test Pit #4 (1-3 feet). Test Pit #4 was located on the southern edge of the former Fort Scott City Dump #1 area which was addressed in 1999 through the KDHE Bureau of Waste Management (BWM) City Dump Program. The former dump was covered including 6 to 8 inches of clean topsoil, graded, placement of rip-rap in certain areas to allow for proper drainage and prevent washout, and vegetated. The former Fort Scott City Dump #1 Site is inspected every five years by KDHE BWM personnel. Considering current and continued future use of this property as a park, routine inspections by the KDHE BWM, and given the Riverfront Authority�s intent to place deed restrictions on all riverfront properties limiting use to recreational/park only, further action is not warranted under the Brownfields Program and the property is cleared for redevelopment.
