1) The berm walls of the former pits shall remain in place, and may not be tampered with in any way that could result in loss of stability. 2) Water diversion and erosion control systems have been permanently installed at the site to aid in natural attenuation of returning pits to greenspace and wetlands area. These systems must remain in place. 3) Groundwater on site cannot be used as potable or irrigation water in the future. 4) Surface water of the impoundments may not be used for livestock. 5) The pits may not be used in the future for any oil and gas activities.

Additional Property Attributes

These mud disposal pits were owned by Royce Kelly and operated as commercial mud pits until he died. The pits were shut down by OCC order in ????. After Royce died, his son, Mickey, enrolled this inherited property into the OCC Brownfields Program.

Former Use: This property was a commercial mud pit run by Royce Kelly before the Corporation Commission had strict rules about how to build a mud pit. The pits were created by damming a creek and building tall berms. The pit was shut down by the OCC, and when the landowner, Royce Kelly, died, his son inherited the property and entered it in the Brownfield Program.
