Additional Property Attributes

The Kansas Department of Health and Environment (KDHE) has received and reviewed your application, dated November 17, 2015 for KDHE to conduct a Brownfields Targeted Assessment (BTA) in Smith Center, KS. A brownfields assessment is necessary to fulfill due diligence requirement prior to renovation for an upper floor apartment and a ground floor retail/service business or office space. Update: KDHE conducted a Phase I Brownfields Targeted Assessment (BTA) on 0.12 acres of property located at 214 South Main Street in Smith Center, Smith County, Kansas. The BTA was performed for Smith Center Economic Development, who intends to redevelop the property as apartments and retail space. Based on the Phase I report, "Recognized Environmental Conditions" (RECs) were identified as the potential for hazardous substances to migrate onto the BTA site from the groundwater impacts associated with the 'Smith Center Shop Upgradient' site (C6-092-72394) located approximately 1,000 feet southeast and upgradient from the BTA property. Major contaminants of concern related to the Smith Center Shop site include carbon tetrachloride, chloroform, and nitrate. A monitoring well network has been installed in the area, and the closest three wells to the BTA site are located approximately 450 feet to the east and southeast. Based on groundwater samples collected in 2011, carbon tetrachloride and chloroform do not appear to be migrating onto the BTA site; however, nitrate was detected during the 2013 sampling event in the three nearby wells at concentrations ranging from 21 to 99 milligrams per liter (mg/L), which exceeds the maximum contaminant level of 10 mg/L. There is a potential that the nitrate impacts are migrating onto the BTA site; however, the Smith Center Shop site is currently enrolled in the Voluntary Cleanup Program (VCP) and is undergoing monitoring and remediation. No further investigation is needed through the Brownfields Program and the property is cleared for redevelopment. A NESHAP Asbestos Survey was also conducted on the Clark Building as an additional scope outside of the ASTM 1527-13 Phase I Assessment. Asbestos-containing material (ACM) was identified in the building as approximately 1,000 square feet (SF) of floor tile/ mastic in the basement, 800 SF of floor tile/ mastic on the 1st floor, 400 linear feet of window glaze and 1,000 SF of ceiling texture. Abatement of these ACM will likely be required prior to renovation and/ or demolition activities. The applicant will be advised to work with the KDHE Asbestos Control Section to comply with all Federal and State regulations with respect to the asbestos.

Former Use: The subject site consists of approximately .12 acres of developed commercial land in Smith Center, Kansas. The property has had the same owner for approximately 50 years, Circle L. Land Company, LLC c.o a Mr. Jay Lyon. The site was first developed in 1890's as a small photograph facility, according to sanborn maps. In the early 1920s the property expanded with office structures. These office structures are still present today.
