Except for wells and devices that are part of a MDEQ-approved response activity, construction or use of wells or other devices to extract groundwater for irrigation, or any other use will be prohibited, without prior evaluation and/or implementation of appropriate treatment or other engineering controls required to prevent potential exposures through ingestion or to prevent exacerbation of existing soil and/or groundwater impact.

Prior to redevelopment activities, the area where benzo(a)pyrene concentrations were identified in soil above the Part 201 Residential DC cleanup criteria will be delineated via the advancement of additional soil borings surrounding the area and the laboratory analysis of associated soil samples for PNAs. Soils exceeding the Part 201 Residential DC cleanup criteria will then be excavated and transported for proper disposal. This will eliminate potential Residential direct contact exposures to the identified benzo(a)pyrene concentrations in soil.

Additional Property Attributes

A developer intends to purchase the property for a new mixed retail and residential development.

Former Use: Standard and other historical sources were able to document that the property was developed with a barn-like structure prior to 1938 in the northeast portion of the property, and was utilized for agricultural purposes from prior to 1938 until 1968, when the land was purchased by for use as a Drive-in Theatre. In approximately 1968, the barn-like structure was demolished. The property was redeveloped with two drive-in movie theater screens, one in the northern and one in the southern portion, along with a manager�s office building and three ticket booths in the central portion of the property. In approximately 1981, an additional drive-in screen was constructed in the central-eastern portion of the property. The property operated as a drive-in theater until the early 1990�s. In 1992, an indoor movie theater was constructed on the southeast portion of the property and the drive-in screen in the central-eastern portion was demolished. The indoor movie theater was vacated in 1998. In 1999, the two outdoor movie screens were demolished. The property remained unoccupied and demolition of the indoor theater building, office building, and ticket booths occurred in 2008. The property has been vacant land with a parking lot in the eastern portion since that time. The east adjoining property is a �facility� and has contamination including 1,2,4- trimethylbenzene (TMBs) in soil above the Part 201 Groundwater Surface Water Interface Protection (GSIP) Criteria and lead in groundwater above the Part 201 Drinking Water (DW) Criteria. Based on the close proximity of this site to the subject property and the presence of groundwater to act as a transport mechanism and the potential long-term operations, the potential exists that contamination from this adjoining property has migrated onto the property.
