Addl Cleanup/Treatment info: In 2019, Joslyn Manufacturing Co. Inc., entered IDEQ's Voluntary Cleanup Program (VCP). Joslyn's contractor completed a Phase 1, QAPP, Phase II, and Human Health and Ecological Risk Assessment to assess subsurface hydrogeologic conditions and the distribution of constituents of concern (COCs) from historical wood pole treating activities in shallow soil and groundwater at the Property. Between May 2019 and March 2020, Joslyn's contractor completed the following site assessment activities: * Installed and monitored 18 shallow groundwater monitoring wells. * Conducted groundwater high-resolution site characterization from 16 Waterloo (APS) borings along two transects. * Completed shallow soil sample collection, using ISM and composite sampling methods, across 5 Decision Units (DUs). * Removed one (1) UST that previously contained gasoline and/or diesel. * Excavated and removed solid waste primarily consisting of steel wire and other metal debris including cans and scrap in the southeastern area of the southern parcel of the Property. In 2020, based on the site assessment results, Joslyn submitted a Voluntary Remediation Work Plan (VRWP) to IDEQ. From October 2020 to February 2021, Joslyn's contractor conducted remediation activities included excavation of impacted soils within the 2.25-acre "Area of Concern" (AOC) that constitutes the former wood treating area, installation of the geotextile AOC cover, confirmation sampling, and waste profiling and disposal, specifically: * Excavated 475.72 tons of contaminated soil from the AOC that was characterized as hazardous and transported to Clean Harbors Aragonite Incineration Facility,Tooele County, Utah. * Imported 475 tons of clean backfill material to construct the AOC cover system area. * Profiled and disposed of additional waste (i.e., demolished concrete, historical debris, root wads, and asbestos-containing material) generated as part of the remediation activities. * Conducted the final groundwater monitoring event that found no COCs at concentrations greater than their action levels and abandoned all 18 shallow groundwater monitoring wells. The cleanup resulted in meeting remedial action objectives in the VRWP.

IDEQ and Joslyn finalized the VCP effort administratively. On December 2, 2021, an Environmental Covenant (EC) for the Property was executed pursuant to the Uniform Environmental Covenants Act, Idaho Code �� 55-3001 through 3015, that allows reuse of the Property for recreational purposes under the EC with semi-annual O&M inspections of the 2.25-acre "Area of Concern" that constitutes the former wood treating area. On December 17, 2021, Joslyn submitted to IDEQ their irrevocable standby letter of credit in the amount of $214,800. for the City to conduct semi-annual O&M inspections (30 years) of the 2.25-acre "Area of Concern."

Why DEQ is requiring a property-specific determination:
Priest River, a small lumber town in northern Idaho with a population of less than 2,000, was recently gifted 48.85-acres of property situated at the confluence of the Priest and Pend Oreille rivers. The timing of this gift coincides with the nation-wide spike in housing prices, inflationary and supple chain pressures on everything, and very limited funding options from local taxes in Idaho. IDEQ's 2-year BILs funding request will go a long way to kickstart the property into the public park the community so desires. Additionally, Idaho's Department of Parks and Recreation is reviewing the City's property for potential funding for the planned campground and Idaho's Department of Fish and Game is considering placing a conservation easement by purchasing the wetlands located on the Pend Oreille River on the property.

IDEQ completed an EJScreen on the greater area of the City and found it qualifies as an EJ community. Specifically, the results found EJ percentiles: 1) particulate matter 2.5, ozone, air toxics cancer risk & air toxics respiratory HI 80-90. 2) population < 5 years64. 3) population % over age 6486. 4) less than high school education60. 5) low income 71. 5) low life expectancy, heart disease, asthma 80-90.

Background: The property was a former wood treating facility from 1920 to 1959. Joslyn Manufacturing Company, Inc. entered IDEQ's Voluntary Cleanup Program and undertook site assessment and remedial activities on the property from 2019 to 2021. Joslyn informed the City that they wanted to give the property to the City, assuming that future beneficial reuse of the Property will be restricted to community access open space. The City entered IDEQ's Brownfield program and requested a Phase I ESA be completed on the property for the City to meet AAI. On December 23, 2021, Joslyn sold the two parcels to the City for the sum of $0.00.

In January 2022, with the City now owning the Property, the city council invited community members to participate in the Joslyn Park Steering Committee (JPSC). The City's contractors lead up the steering committee and held five (5) public meetings from March 2022 to October 2022. JPSC's effort resulted in a "Master Plan" for the Property to develop a sustainable multi-use park that serves Priest River as a community gathering space and provides varied year-round recreational opportunities for Bonner County residents as well as visitors. The park will include uses and venues that generate revenue to ensure long term viability of the park by offsetting operation and maintenance costs. On January 17, 2023, the City Council approved the JPSC Master Plan for the revitalization of the property.

In November 2022, IDEQ personnel discovered that a historic wooden stormwater channel had collapsed on the Property. The stormwater channel runs across the southern parcel and empties into the Pend Oreille River. The channel is less than 100-feet away from the 2.25-acre AOC barrier consisting of geotextile membrane of screen and cloth covered by two feet of dirt. The collapse of stormwater poses several risks to the community:
1) a large stormwater runoff event could impact and damage the integrity of the AOC cover.
2) the stormwater outfall is eroding the Pend Oreille River shoreline annually and decreasing the property's footprint.
3) The increased sedimentation from the stormwater outfall is impacting the City's public water intake system in the Pend Oreille River, located 800-feet downstream.

IDEQ plans to conduct site-specific work at the Property related to these three issues listed above that requires assessment activities that may include surface and subsurface soil samples. Additionally, IDEQ's Brownfield program will continue the outreach and planning efforts for the City. Initial steps include: 1) JPSC public outreach, 2) signage for the property, 3) wetlands delineation, 4) LiDAR drone derived elevation contours, 5) 1
