Additional Property Attributes

(From PRP Removal Report 1998) Original owner is believed to be American Automobile Screw Products Company. Property ownership changed to an unknown owner from 1926-1936. In 1936, American Vitrified Products purchased the property and operated and operated on site until 1945. From 1945 to 1974, the Ohio Bronze Powder Company operated at the facility. In 1974, the property was sold to the A.O. Smith Corporation, which then sold the property to the GTE Products Corporation. In 1982, Sanford S. Malkin purchased it and leased it to GTE Products Corp. From 1984 to 1993, several businesses leased the facility and conducted various activities at the property. The American Allied Additives Company owned and operated the property from 1993 to 1996. In April 1996, the property was purchased by Midtown Industrial Warehouse, which was owned by James Kirwan. On November 25, 1996 an initial property reconnaissance was conducted by Joseph Fredle of US EPA. On Dec. 20, 1996 US EPA issued a unilateral Administrative Order under Section 106 of CERCLA to PRPs. In 1997 drums were removed from the property. In 2004 inspections by City Fire Division officials found large quantities of engine parts wrapped in cellophane were on property with numerous other debris. On April 20,2000 Judge Lesley Wells ruled that the U.S.'s motion for default judgment against Defendents James Kirwan and Midtown Industrial Warehouse was granted. In the motion the U.S recommended a total amount of $174,000 in civil penalties for noncompliance with the US EPA's UAO under Section 106 of CERCLA, 42 U.S.C. Sec.9606. (U.S. v American Allied Additives, Inc. et al., Case No.1:00 CV 1014). In the same case, on July 29, 2004 the Clerk of Court's Issued a Notice of Garnishment to James Kirwan and Lextech Industries, Ltd., dba Clepro Division in case number 1:96MC339 in the sum of $502,627.03 a balance of $619,408.55 remained outstanding. In October, 2004 City attorneys spoke to Richard French of the U.S. Department of Justice who expressed that the federal government might be willing to release any liens on E 152nd Street and collecet the judgement through some other means if it would assist the economic development of the property by the City. Former Use: Two story office building and industrial warehouse covers much of the property. The remainder is asphalt parking and drive way. Buildings are in poor condition and disrepair. Mostly concrete, steel and wood construction. Past operations are unknown???, though it is obvious that industrial activities have been ongoing at the property for many years. The buildings were built around 1941.
