On May 16, 2007, Wednesday - Official Request (email) was sent to USEPA for assistance via the USEPA Emergency Response Program to respond to Unforseen PCB contamination in concrete and soil which posed a potential risk to adjacent residential row houses and their occupants. The City felt the challenges posed by the discovery of PCBs were beyond Citys capacity, expertise, and available resources. Throughout the spring and summer of 2007, USEPA conducted several assessment events and an interim cleanup response action. During the week of December 3, 2007 - USEPA conducted an interim cleanup at the property to remove PCB contamination that was threat to adjacent residents and/or off site migration. On December 5, 2007, USEPA Region 5 Office of Regional Counsel notified the City of its status under CERCLA 107 (a)(2) as a Potential Responsible Party Ongoing - The City of Cleveland continues conversations with USEPA, Region 5 concerning the City's status as a PRP, other PRPs, and the future of the property's cleanup. City of Cleveland awaits a USEPA determination as to the City's status as a PRP under CERCLA. Please see City's last Quarterly Report for more information.(PPF - Trinity Building, 1/16/08). According to Regional reviewer, the USEPA has determined that the City is not a PRP.
