IDEQ issued an environmental covenant (property deed restriction) on the property: 1) restricting any extraction of groundwater from under the Property for human consumption, 2) the property may be used for commerical and industrial purposes only (may not be used for residential purposes, agricultural purposes, hotels, motels, schools, day care centers, or hospital use) and 3) there shall be no excavation below 4-ft in the southeast section of the property except in accordance with a soils management plan approved by the IDEQ. IDEQ issued a Certificate of Completion and the Covenant-Not-To Sue.

In 2006, the owners of Alpine Lumber were approached by a perspective purchaser; however, uncertainty regarding wood treating chemicals on-site threatened to put a stop the transaction. The City of Sandpoint sent IDEQ a letter requesting assistance from IDEQ�s Brownfields program. IDEQ�s contractor conducted a Phase II ESA in October 2006 to identify the vertical and horizontal extent of any wood treatment chemical contamination in shallow soil and groundwater at the Alpine Lumber. In January 2007, IDEQ completed a risk evaluation based on the Phase II sampling data that indicated the potential for off-site migration on shallow soil and groundwater onto the adjacent properties: 1) Ted Gordon private residence located east across Division Street and 2) Albright and Thurston commercial property located south across the railroad tracks from Alpine Lumber. In April 2007, IDEQ's contractor completed a supplemental Phase II on the Alpine Lumber property, Ted Gordon property and the Albright & Thurston property. Results from Phase II showed the impacts to soil and groundwater from volatile organic compounds are restricted to the southeastern portion of the Site at depths greater than 5 feet. On August 28, 2007, Alpine Lumber entered into DEQ�s VCP Program to use an environmental covenant that set forth protective provisions, covenants, restrictions and conditions (collectively referred to as �Activity and Use Limitations�) on their properties. These restrictions implement remedial actions that Alpine Lumber Company and any successors in interest, are hereby restricted from using the Property, now or at any time in the future, as set forth below: 1. Any extraction of groundwater from under the Property for human consumption is prohibited. 2. The property may be used for commercial and industrial purposes only. The Property may not be used for residential purposes, agricultural purposes, hotels, motels, schools, day care centers, or hospital use. 3. There shall be no excavation below 4� in the southeast section of the property except in accordance with a soils management plan approved by the Department. This section shall be defined as an area beginning at a point 25 feet west and 25 feet south of the quarter corner between Section 15 and 16 of the Northeast Quarter of the Southeast Quarter of section 16 Township 57 North Range 2 west Boise Meridian. Then west a distance of 300 feet. Thence south 228.2 feet. Thence South Easterly 309.3 feet along the North line of said right of way or the Great Northern Railway Spur. Then North 306.2 feet to the point of beginning. Once the environmental covenant was recorded with the County, Alpine Lumber requested and was issued by DEQ a Certificate of Completion and the Covenant-Not-To Sue.

Former Use: In May 1996 EPA released "Site Inspection Report for the North Sandpoint Wood Treating Facilities, Sandpoint, Idaho" CERCLIS ID No. ID0001411321 dated May 24, 1996. The report found that from 1917 to the 1950�s the Division Street Wood Treating property was owned and operated by wood treating companies. The property was split into two sections by North Baldy Road, with approximately 12 acres located north of North Baldy Road and approximately 5 acres located south of North Baldy Road. In 1984, Alpine Lumber Company (dba Bitterroot Investments, LLC) was formed when two partners acquired a 4-acre parcel located at Division Ave and Baldy Mountain Rd, Sandpoint. Due diligence in the form of an environmental site assessment was not completed for the sale because it was not required by lenders at that time. In 2006, the owners of Alpine Lumber were approached by a perspective purchaser; however, uncertainty regarding wood treating chemicals on-site threatened to put a stop the transaction. The City of Sandpoint sent IDEQ a letter requesting assistance from IDEQ�s Brownfields program. IDEQ enrolled the property into the Brownfield program in September 2006.
