In 2000, the VT DEC requested CVPS potentially responsible party to conduct corrective action to address the contamination on the land. In August 2003, an agreement was reached between the Town of Brattleboro current property owner and the State of Vermont to place certain deed restrictions on a portion of the property that once housed the main gas works building. This agreement is referenced as �Grant of Environmental Restrictions� which restricts residential and child day care from operating on this portion of the property, restricts groundwater use, and restricts building re-use. The groundwater is actively being monitored under the oversight of the VT DEC through a voluntary agreement with CVPS. The next round of groundwater monitoring is scheduled Spring 2012 to observe groundwater flow and contaminant trends.

Additional Property Attributes

This property is approximately 0.296 acres. A Phase I Update is required to investigate what has occurred on the site since the last site investigation in the 1990�s. The intent of the property owner is to redevelop this site, simultaneously with 3 other adjacent properties, to connect downtown Brattleboro with its waterfront. Possible redevelopment scenarios include the creation of a public park with a variety of build-out scenarios. In the 1800�s, the property was used for a Gasworks that converted coal into gas for heating and illumination. The building on this property was an active part of that operation. One of the byproducts from the gasification process is coal tar. The property was investigated in 1990 and coal tar deposits were found in a number of areas both on the property and in sediments of the Connecticut River. While the site was found to be contaminated, the assessment concluded that human activity on the site was safe as long as the tars remain undisturbed. Corrective actions were taken in the 1990�s and a SMAC letter was issued by the Vermont Department of Environmental Conservation in 1991. The Corrective Action included placing a restriction on the property that prohibits parties from digging down more than five feet below grade.

Former Use: CERCLIS#VTD980915078 The Brattleboro Gas Works operated between the mid-1800�s to 1949 producing manufactured coal gas for the town of Brattleboro. The south side of Bridge Street contained the main gas works buildings and the north side housed a large circular brick tank for coal gas storage. During this production an unknown amount of waste material in the form of coal tar was disposed onsite and directly into the Connecticut River. Since 1949, the southern portion of the property has housed several businesses including Synergy Gas Company and more recently Central Vermont Public Service Corporation CVPS . This parcel is currently owned by the Town of Brattleboro and undergoing redevelopment through the EPA Brownfield Program. The northern side has housed the Riverview restaurant since 1975. Contaminants of potential concern include benzene, toluene, ethylbenzene, xylenes, naphthalene & PAHs. These compounds have been detected in onsite soil, river sediment & in groundwater. There appears to be small amounts of free phase coal tar at depth beneath the land & in the river bottom sediment however it appears to be in steady state and not migrating. The NH DES has been managing impacts to the river under NHDES#198402036. It has been concluded that there is coal tar or coal tar related material in river sediments near the property deeply buried. The coal tar does not appear to be mobile & causing unacceptable threats to human health and the environmental. This property is part of a much larger waterfront redevelopment project that includes properties identified as VT DEC SMS# 77-036, 2008-3846, 2008-3845 & 2008-3836. The next round of groundwater monitoring is scheduled Spring 2012 to observe groundwater flow 7 contaminant trends.
