UST removal information: On March 12, 2010, WESTON and the Tribe provided a 5-day advance notification for UST closure in accordance with Comm 10.560, Wis. Adm. Code Tank System Closure. A Comm 10 Notification Record Form ERS-9198 was completed, as required, and submitted to Mr. Randy Barnes of CFD Inspections in Conover, Wisconsin. In addition to the advance notification for UST closure, the Tribe�s Brownfield Department was tasked to obtain a cultural resources permit from the Tribal Historic Preservation Officer in accordance with the National Historic Preservation Act and Chapter 66 of the Tribal Code. WESTON received a signed Permit which authorized excavation and removal of the UST system at the subject Site. On March 30, 2010, WESTON mobilized to the Site to conduct oversight of UST removal activities. WESTON subcontracted SGS Environmental Contracting, LLC SGS to complete UST closure activities in accordance with the Technical Specifications for Closure of the UST System and Site Restoration WESTON, FEB 2010. In turn, SGS subcontracted REI Engineering, Inc. to provide a Certified Tank-System Site Assessor Andrew Delforge, No. 243858 for completing a tank-system site assessment. The UST excavation measured approximately 14 feet long, 7 feet wide, and 7 feet deep. The excavation uncovered a 1,000-gallon, bare steel single wall UST with steel and copper piping construction. Before UST removal, SGS personnel cut a hole in the UST to allow for tank cleaning and residual liquid removal. UST contents were described as fuel oil, and SGS estimated that approximately 20 gallons of residual liquid remained in the UST at the time of removal. According to the non-hazardous waste certification manifest provided by Chief Liquid Waste, Inc. of Winneconne, Wisconsin, approximately 125 gallons of non-hazardous liquid was removed from the Site and disposed at Chief Waste Treatment Corporation in Kimberly, Wisconsin. After removal of the UST, REI personnel collected two floor samples from beneath either end of the tank at an approximate depth of 6 feet below ground surface. Sample aliquots were screened using a photoionization detector. Additional aliquots were placed into laboratory-supplied sample bottles, preserved on ice, and transported to Pace Analytical Services, Inc. of Green Bay, Wisconsin for subsequent analysis. The floor samples were analyzed for diesel-range organics DRO and petroleum volatile organic compounds PVOCplus naphthalene in accordance with Wisconsin Department of Commerce WDCOM guidelines and WESTON�s February 2010 Sampling and Analysis Plan SAP. The PVOC plus naphthalene samples were field-preserved with methanol. Sidewall samples, as described in the WDCOM guidelines and WESTON�s SAP, were not collected because no indication of a petroleum release was identified by the certified Tank-System Site Assessor and groundwater was not encountered in the tank excavation. The floor samples exhibited DRO concentrations of 4.4 and 2.4 milligrams per kilogrammg/kg, respectively. PVOCs and naphthalene were not detected in either sample. ch. NR 720,Wis. Adm. Code provides risk screening and closure criteria for petroleum product contaminated sites. The low-level DRO concentrations, as represented by the tank pit floor samples, do not attain or exceed the risk screening criteria of 100 mg/kg. After sample collection, the excavation was backfilled with the original excavated material because it was determined that no release had occurred and the backfilled material was compacted using the excavating equipment.

Former Use: Based on available records, the Subject Site, referred to as the �Cop Shop�, located at 623 Peace Pipe Road in Lac du Flambeau, Wisconsin appears to have been undeveloped until the 1950�s, and then was subsequently used by two hardware stores until the 1980�s, after which it was vacant for an indeterminate period of time before it was sold to the Lac du Flambeau Tribe in 1991.
