Additional Property Attributes

The property is currently owned by Area 51 Development 3 LLC. The previous owner of the property is Crystal 40 LLC. The property comprises a well pumphouse, an abandoned cinderblock building, a water system, two septic systems, two unimproved roads, and two inactive billboards. The land use is residential. The owner of the property also owns the adjacent rest stop and is interested in expanding the commercial operation to improve access to services and accommodate more visitors in the area. This redevelopment would remove the blight of vacant, dilapidated buildings at the highway commercial center of Amargosa Valley at the Lathrop Wells intersection (the junction of U.S. Highway 95 and State Route 373), in addition to creating more jobs for residents in this rural area. In addition, the owner of the property proposes to use the groundwater from the well located on the property as a potable water supply to direct expansion of commercial operations. An orphan site discovered through a Phase I Environmental Site Assessment (ESA) prompted a Limited Phase II ESA. The orphan site is the Amargosa Valley Saloon (NDEP Facility ID 7-000163), which is located 0.05 miles southwest of the property. During the removal of underground storage tanks (USTs) located on the site, a release of petroleum hydrocarbons to soil was discovered. The release was reported to the Nevada Division of Environmental Protection (NDEP) on March 24, 1999. An "A through K" evaluation was performed in accordance with NAC 445A.227. Based on this evaluation, NDEP granted the site an A-K closure on August 18, 2000. However, one of the evaluation criteria was proximity to drinking water wells. This site closure criterion was determined to be "not applicable" during the evaluation, despite records of a domestic well being present at the property since 1963. This Controlled Recognized Environmental Condition (CREC) was considered a Recognized Environmental Condition (REC) at the time of the Phase I ESA based on the proximity of this release to the property and the presence of a well on the property. In addition, the potential for the paint on the two inactive billboards to contain lead was considered a Business Environmental Risk (BER). Arsenic was detected above state drinking water standards in groundwater samples analyzed as part of the Limited Phase II ESA. Based on this finding, further investigation and/or treatment of groundwater from the onsite supply well prior to its use as a drinking water source is recommended. This recommendation is consistent with the findings in the Limited Phase II ESA report.
