Additional Property Attributes

The property is comprised of a 2.01-acre parcel and is currently developed as the Historic Nye County Courthouse, which is an approximately 22,689 square-feet structure. According to historical records, the courthouse was constructed in 1905, with a two-story jail added in 1907. Additional renovations to the courthouse were completed in 1965. An additional building, which is located on the eastern side of the parcel, was constructed in approximately 1981. The property has been owned by Nye County Commissioners. Currently, Nye County is renting space to non-profit organizations, including the NyE Communities Coalition, for daily use in the courthouse building and the additional building on the parcel. The regulatory database review as part of the Phase I Environmental Site Assessment (ESA) identified the property as the Nye County Sheriff's Office in the State of Nevada underground storage tank (UST) database. According to case file records, the tanks were installed in May 1974 and were determined to be out of use as of January 1975. Due to the unknown quantity of gasoline and diesel fuel remaining after the USTs ceased to be used in 1975, lack of laboratory analytical data related to the UST removals in 1987, unknown location of previous USTs on the property, and recent earthquakes possibly affecting fracture-flow pathways from possible undocumented petroleum remaining in the soil from the time of the UST removal, this was considered a Recognized Environmental Condition (REC) for the property. A Phase II ESA was performed in 2022 identifying the presence of asbestos and lead-based paint (LBP) in building materials; concentrations of benzene in indoor and outdoor air samples and soil-gas samples; elevated levels of radon in one indoor air sample; and elevated mold levels in indoor air samples. Due to elevated levels of benzene and radon, a Vapor Encroachment Condition (VEC) is considered present for the property. The NyE Communities Coalition plans to use the building to support the needs of the organization. The specific plans were not yet decided at the time of the Phase II ESA.

Recommendations regarding future use and steps for the property include abatement of building materials containing asbestos, LBP, and mold is recommended before any building renovation or demolition activities occur. In the interim, these materials should be inspected regularly to ensure they are not chipping, flaking, disintegrating, or becoming friable (i.e., more mobile). A VEC remains on the property. Elevated concentrations of benzene in soil-gas and indoor air may require institutional controls (ICs) to prevent the property from future residential use. Installation of vapor protection in the building, or further investigation to determine the source of the soil-gas and indoor air contamination and subsequent remediation to mitigate potential impacts on human health is recommended. Additionally, radon mitigation measures should be applied in areas of elevated radon readings to control indoor radon levels. A licensed heating, ventilation, and air conditioning (HVAC) professional is recommended to inspect the adequacy and condition of the HVAC systems within the courthouse. Any repairs or improvements to these systems should occur prior to mold remediation activities and include addressing all areas of water intrusion, staining, and visible mold; repairing all sources of water intrusion into the building by licensed professional contractors; and removing mold-affected materials concurrent with asbestos and/or LBP remediation by licensed professional abatement professionals. Additionally, professional third-party professionals should inspect the tightness of the courthouse propane lines to ensure no leaking is occurring.
