Additional Property Attributes

The Subject Property consists of an approximately 3-acre allotment designated as communal tribal land for residential use. The allotment is located at the eastern extent of East Creek Way and is reported by the Nation to be 5 East Creek Way. The Subject Property lies within a residential area in the Shinnecock Indian Nation. Residential homes are located to the north, south, and west of the Subject Property. Tidal wetlands and Heady Creek are located immediately adjacent to the east of the Subject Property. Heady Creek flows to Shinnecock Bay. Shinnecock Inlet, a shallow water area in the bay, connects Shinnecock Bay to the Atlantic Ocean. Heady Creek, which is subject to ebb and flow of the tide, is a water subject to the jurisdiction of Section 10 of the Rivers and Harbors Act and is considered a navigable waterway.
The area in the vicinity of Subject Property was initially developed as farm prior to 1938, and subsequently divided into smaller allotments for use by the tribal community. At the Subject Property, the allotment appears to have been initially developed between 1980 and 1985. Although the allotment was granted to the prior occupant (Mr. Gordon Smith, Sr.) for residential purposes only, Mr. Smith used the allotment for business (automobile maintenance/repair) and allowed import of waste materials from unknown sites. Based on anecdotal information provided by the Nation, and supported through historical aerial imagery review, unregulated filling in the wetland adjacent to Heady Creek began in 2013 and continued through 2019 until the death of Mr. Smith, Sr.
Approximately 1 acre of the Subject Property is cleared of vegetation, unpaved, and consists of tidal wetlands adjacent to Heady Creek. There is a steep slope (approximately 6 feet in height) leading down to the wetlands from the parking/storage area. Nobis observed exposed filled material including concrete, slate, brick, metal/re-bar, broken ceramics/terracotta, plastic, piles of grout/plaster, burnt wood and cinder blocks comingled with what appeared to be imported fill (gravel and dirt) protruding from the ground surface in the parking/storage area and along the slope down into the wetlands. Several pieces of concrete had brown and/or green paint coating the surface. Several pieces of concrete were very large. The area where filling appears to be present is approximately 175 feet long by 25 feet wide (0.1-acre). Based on the height of the slope leading up to the parking/storage area, it is estimated that 970 cubic yards of filled material is present. The remaining area of the Subject Property is occupied by a residence, and several outbuildings (access was not available for interior inspections) presumably used for the automobile repair/maintenance activities.
