Additional Property Attributes

The approximately 0.146-acre subject property is located at 103 Central Avenue North, Harlowton, Wheatland County, Montana. The subject property consists of one, three story building vacant commercial structure that was historically used as retail space and a movie theatre. The building is identified as the former The State Theater. The existing structure occupies 99% (estimate) of the property; however, there are off-site buildings that adjoin the State Theater on the north and south sides of the theater building. The building was constructed prior to 1910 and has functioned as a theater with retail space fronting Central Avenue since construction. The building is currently without a roof or any interior finishes having sustained significant fire damage in 2012. The August 2022 Phase I ESA identified the following recognized environmental conditions (REC), vapor encroachment condition (VEC), business environmental risks (BER):

* The property is downgradient and within 350-feet (estimated) of multiple historic laundry facilities, gas and oil facilities, and an automotive repair and automotive parts (vulcanizing) operation. The historic presence of these facilities is both a REC and VEC.
* A 2-inch capped pipe enters the ground at the back side of The State Theater.
* Remaining debris from the 2012 fire is present on the floor of the theater, specifically in three piles. The building debris is identified as a REC because it has a potential to contain
constituents that would make it a classified or hazardous waste if improperly disposed of.
* The building is likely to contain both asbestos containing material (ACM) and lead based paint (LBP). These are considered BERs.
- The Phase I ESA Report recommended Phase II ESA sampling activities.

The Phase II sampling activities consisted of:

- Conducting a hazardous materials survey, collected samples of suspected ACM from within the theater building and screened the building for LBP.
* Collected two sub-slab vapor samples from the basement of the theater for volatile organic compounds (VOCs) laboratory analysis.
* Collected three fire debris composite samples from the lobby and stage area of the theater for VOCs, semi-volatile organic compounds (SVOCs), and Resource Conservation and
Recovery Act (RCRA) metals.

The Phase II ESA concluded:

Building debris samples analyzed for metals, VOCs, and SVOCs reported values that were all below
EPA TCLP levels. START recommends that no further sampling be performed, and the three building
debris piles can be disposed of at a non-hazardous landfill.

No detected VOC concentrations exceeded the applicable EPA VISL for sub-slab soil gas
concentrations.
All detected VOC concentrations were less than the applicable EPA VISL and Montana DEQ RSL for
sub-slab soil gas concentrations. START recommends that no further sampling for sub-slab soil gas
be performed.

ACM and LBP was detected throughout the apartment building; Phase II report recommended ACM and LBP removal and disposal in accordance with applicable regulations.
